Anyone involved in a self build will need to document what they are doing, need to write a variety of letters, obtain quotations, set out agreements, order materials and deal with problems and variations of these and many other items. While many people would be able to undertake much of this themselves, with research and thought, it is largely duplicated or wasted effort in that once a form, agreement or letter has been written it can then be used by a wide range of others, as it is or modified slightly, to suit your exact needs, saving time and allowing faster progress to be made.
The club has a very long list of standard forms and agreement blanks, covering a wide range of topics. They cover everything from land options to prenuptial agreements, with the concentration on the ordering supply of items, contracts with contractors and resolving disputes relating to work, goods, or other problems or associated with property or the building of property.
These have been drawn up to save members the trouble or expense. Most are based on common forms or agreements is use, at the moment the collection is still being expanded.
We have opted for forms and agreements written in plain English rather than legalize, and these we would expect would suit most needs. At a later point we propose to form a panel from members who are legally trained in the UK and to have each of these reviewed and modified to make them as near legally water tight as possible.
While we believe that the use of forms and blanks can be helpful and save you a lot of time and expense, we cannot guarantee that each is the right one for you to use, or that what you have added to it is the most relevant information.
To avoid disputes, particularly with contractors, we suggest that written agreements are entered into, that any agreed variation from this agreement is acknowledged in writing by you, and that any shortfall or problem is fully documented at the point it occurs and any subsequent action, discussion or other relevant detail is noted and dated. However it is written, any agreement is better than none, and for variations to agreements you may find that a duplicate book provides a convenient way to make rapid notes and leave a copy with the contractor. A rubber stamper can be made that states that it is an agreed variation to the agreement and subject to your standard variation form agreement conditions, supplied to them before. This is covered in the build pack in greater detail.
The forms and blanks fall into three groups: Pre build, build, and others.
Pre build - this is forms and blanks connected with getting quotations, taking and transferring land options, confidentiality of information, and others that might be needed in the early stages.
Build - This is forms and blanks connected with contracting services, purchasing, problems with goods, delivery, risks, remittance advice, trade credit account application, and the build pack which is to do with scheduling and managing the build.
Others - This is a wide range of other forms and blanks that you may have a need for from agreements to rent out property, to house sharing, photo releases, standing orders, and many others.
There are also a few club forms such as standing orders, membership application forms and other documents.
So how do you get access to the forms and blanks, and know what is available.
The first two groups are on CD's that members are given, the pre build when a personal definition has been created and agreed, and the build cd when the member has made a purchase of a plot. On each of these CD's is an index of all the current forms available and explanation of what each is for. There is also a link to a web page that has an updated version of this index allowing members to check for any later forms or blanks that may suit their needs.
Once a member has one of the CD's they can then access any of the forms or blanks from the internet, via the extended form index on line. At some point soon, this system will be updated on the internet so that the member will log in and have a password to access this information. All current users will be given passwords and then in future, members will be issued a password with their disk, access will then cease if the person ceases to be a member.
Members who do not have internet access can call the clubs admin company, who will print out a blank and mail to them. A printed index of forms is to be produced to make this simpler for these members to use. We are also looking into pre printing sets of blanks, as sets, that can be ordered by members.
