Can you get planning permission on sites which have been turned down

A.

This can be a difficult question to answer. 

People get turned down for planning permission for a whole range of reasons, and probably about 80% of these cases have some sort of solution that would allow them to gain some planning permission, but not necessarily the exact one they wanted. 

In some ways the problem is in the misunderstanding of the planning process. There are no absolute rules to planning, its local politics. The planning officer may advise, but the councilors can still pass or reject most proposals. Having said this its far more predictable in practice, and there are a range of things that can be done to improve drastically the chance of gaining planning consent.

In many cases, its a case of finding a solution to the problem, in other cases making the problem go away. Perhaps there is a compromise and in some other cases perhaps we have to document other permissions that have been given, that is so similar that this one should have been granted as well. Similarly the local plan may provide the answer and in other situations it may be that a more radical and larger scheme is required.

In some cases its just that it has not been well presented, in that the objections were not dealt with, in other cases the problem was not getting the locals on your side. There is a tendency for people to object to just about anything that is happening, and failing to explain and take into account the views of others can lead to problems that could have been avoided. Many of us suffer from the problem that we are so excited about an idea that we expect others to be as well, perhaps without giving them the benefit of as full an explanation as we could. Many people for example just can't imagine a building from a plan, so a small model may be required to allow them to see what it is you are proposing, or special photos to show views from windows or how a property will, in a couple of years, blend in.

From what I have said here you can see that we can in many cases get planning permission on sites that have previously been turned down, but no one can in all cases. The system exists to protect the interests of others, and as such it can be a good thing, as well as a problem to overcome.
